This page describes the terms and privacy practices for the Breath of Life SMS/text messaging program operated by Breath of Life, Inc. (“Breath of Life,” “we,” “us,” or “our”).

This SMS Privacy Notice supplements our general Privacy Policy. For information specifically related to our SMS program, this notice controls if it conflicts with our general Privacy Policy, including its provisions concerning the sale or sharing of personal information.

When you sign up for our SMS program, we collect your mobile phone number and records of your subscription and consent, including when and how you subscribed and the disclosures presented to you.

Cart Reminders

Our website uses cookies and integrated tracking tools to identify items added to your shopping cart and when a cart or checkout has been abandoned. If you have expressly opted in to receive cart-reminder texts, we may use this information to determine when to send those messages.

2. Mobile Terms of Service

Program Description and Consent

By expressly opting in to the Breath of Life SMS program, you agree to receive recurring text messages from or on behalf of Breath of Life at the mobile number you provide.

Messages may include product-development updates, launch announcements, preparedness resources, promotions, special offers, and cart reminders where you have consented to them. Where separately requested or otherwise authorized, we may also send service-related messages, such as order updates and account alerts.

Messages may be sent using an automatic telephone dialing system or other automated technology. Your consent applies to the messages you agree to receive, even if your number is registered on a state or federal Do Not Call list.

Visiting our website or viewing this page does not, by itself, constitute consent to receive marketing text messages.

Voluntary Participation

Participation is voluntary. You do not need to subscribe to our SMS program to make a purchase, and consent to receive marketing text messages is not a condition of purchase.

Message Frequency and Charges

Message frequency varies.

We do not charge a separate fee for participating in the SMS program. However, message and data rates may apply under your wireless plan. You are responsible for charges imposed by your wireless provider. Contact your provider for details.

How to Unsubscribe

Reply STOP to any message from the program, or text STOP to +18777376603, to unsubscribe. You may also use an unsubscribe link where one is provided.

You may receive one final message confirming your unsubscribe request. After that, we will stop sending messages covered by your request unless you subsequently provide new consent or initiate a communication that requires a response.

Your Mobile Number

Provide a valid mobile number that you own or are authorized to use.

If you change or relinquish your number, unsubscribe before doing so. To receive messages at a new number, sign up again using that number.

Changes to Sending Numbers

We may change the telephone number or short code used for the program and will notify subscribers of relevant changes.

Messages sent to a discontinued number may not reach us. If you cannot reach us through a previous sending number, contact the support email above. Nothing in these terms limits our obligation to honor valid revocation requests under applicable law.

Delivery and Carrier Responsibility

Message delivery depends on your wireless provider and other technical factors. Delivery may be delayed or unsuccessful, and messages may not be available on all devices or networks.

Wireless carriers are not liable for delayed or undelivered messages.

Limitation of Liability

To the extent permitted by applicable law, Breath of Life will not be liable for failed, delayed, or misdirected message delivery, errors in messages, or actions taken in reliance on the SMS program.

Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Changes to the Program or This Page

We may modify, suspend, or discontinue the SMS program, subject to applicable law.

We may update these terms and this SMS Privacy Notice by posting a revised version and updating the date above. We will provide additional notice or obtain renewed consent where required by applicable law. Changes do not expand your SMS consent without any additional consent required by law.
